California-Based Breakfast Chain Sues Malden Restaurant Over Name

A Malden eatery is being sued by a California-based chain of breakfast spots for allegedly infringing on its trademarked name.

According to an article in the Boston Business Journal and a post from Universal Hub, BYC Inc., which operates locations of the Broken Yolk Cafe, is suing the Broken Yolk Cafe on Broadway, based on documents that were filed in federal court earlier this week. The article mentions that the San Diego-based chain said it asked the Malden spot in early December to stop using the name, but states that it continues to run as the Broken Yolk Cafe so the chain is now requesting a trial along with a money payment based on the Malden restaurant's use of the trademarked name as well as any lawsuit-related expenses, fees, and costs.

The Broken Yolk Cafe chain was established in 1979 and currently has 17 locations in California and Arizona, while the Broken Yolk Cafe in Malden first started out in 2003, according to a page within the Manta site.
